Terms of Service
1. Acceptance of terms
By accessing or using Finixr ("the Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you may not use the Service. The Service is operated by Albusi GmbH, Witikonerstrasse 487, 8053 Zurich, Switzerland (UID 020.4.078.165-9).
If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2. Description of the service
Finixr is an AI-powered platform offering two distinct products:
- Document generation. Users submit briefs via email or the web application; the Service uses artificial intelligence to produce business documents including pitch decks, research reports, and financial presentations. Output is delivered as PDF and PPTX files via email.
- Model audit. Users upload a spreadsheet financial model. The Service analyses it using several independent AI models and returns a written report identifying suspected errors, inconsistencies, structural weaknesses and unsupported assumptions, delivered on screen and as a downloadable PDF.
The two products are billed separately and neither includes the other.
3. Eligibility
You must be at least 18 years old to use the Service. The Service is intended for business use. By using Finixr, you represent that you are using it for commercial or professional purposes.
4. Accounts and access
Access to Finixr is granted on a per-company basis via a dedicated workspace email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at business@alanany.com if you suspect unauthorized access.
We reserve the right to suspend or terminate accounts that violate these Terms or that we have reason to believe pose a risk to the platform or other users.
5. Subscriptions and payment
Finixr is offered on a subscription basis billed monthly or annually. By subscribing, you authorize Albusi GmbH to charge your payment method through our payment processor (Stripe) on a recurring basis at the then-current subscription price.
- Monthly plans — billed on the same day each month. Prices are in CHF or EUR as displayed at checkout and include Swiss VAT where applicable.
- Annual plans — billed once per year. Annual subscribers receive a discount compared to equivalent monthly billing.
- Price changes — we will give at least 30 days' notice before increasing subscription prices. Continued use after the effective date constitutes acceptance of the new price.
- Failed payments — if a payment fails, we will attempt to retry. Access may be suspended if payment cannot be collected after reasonable attempts.
All fees are exclusive of taxes unless stated otherwise. You are responsible for any applicable taxes in your jurisdiction.
6. Model audit credits
Model audits are not sold by subscription. They are sold as credits: a one-time purchase of a fixed number of audits, charged once through Stripe at the price displayed at checkout. Nothing recurs and nothing renews.
- What a credit buys. One credit entitles you to one full audit of one workbook. Prices per credit are shown at checkout and may differ between bundle sizes.
- When a credit is spent. A credit is consumed at the moment a full audit begins, not when the report is delivered. If the audit fails to complete, the credit is returned to your balance automatically.
- Expiry. Credits do not expire while your account is open. Credits remaining on an account you delete are forfeited, which is stated on the deletion screen before you confirm.
- Free scans. A limited free scan is offered before purchase. It is a single-pass analysis, materially weaker than a paid audit, provided as a sample and subject to rate limits. We may change or withdraw it at any time.
- Refunds. Governed by our Refund Policy.
7. Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period, after which you will not be charged again. You retain access to the Service until the end of the period you have already paid for. See our Refund Policy for details on refund eligibility.
8. Acceptable use
You agree not to use the Service to:
- Generate content that is illegal, harmful, defamatory, fraudulent, or deceptive
- Violate any applicable law or regulation, including export controls and sanctions
- Attempt to access, probe, or disrupt any systems or infrastructure underlying the Service
- Reverse-engineer, decompile, or create derivative works based on the platform
- Share or resell access to the Service without written permission from Albusi GmbH
- Submit content that infringes any third-party intellectual property right
- Misrepresent AI-generated output as independently verified professional advice
We reserve the right to remove content or suspend access without notice if we determine that these terms have been violated.
9. Your content and intellectual property
You retain ownership of all content you submit to the Service (briefs, uploaded documents, brand guidelines). You grant Albusi GmbH a limited, non-exclusive license to process this content solely to provide the Service to you.
Documents generated by Finixr on your behalf are yours to use, share, and commercialize. We make no claim to ownership of generated output.
The Finixr platform — including its design, software, AI models, and underlying technology — is the intellectual property of Albusi GmbH. Nothing in these Terms transfers any ownership of platform IP to you.
10. AI-generated content disclaimer
Finixr uses AI models to generate documents and to analyse uploaded models automatically. Output may contain errors, inaccuracies, outdated information, or content that requires expert review. Nothing produced by Finixr constitutes professional financial, legal, medical, accounting, or investment advice. You are solely responsible for reviewing, verifying, and assuming liability for any use of generated content.
The word "audit" does not carry its regulated meaning here. A Finixr model audit is an automated analysis produced by AI systems. It is not a statutory audit, not an assurance engagement, not a review or agreed-upon-procedures engagement, and it is not performed, supervised, or signed off by a licensed auditor, accountant, or any regulated professional. It carries no opinion, no certification, no assurance and no professional liability. It must not be presented to any third party as if it were any of those things.
A clean report is not a guarantee. The Service reports what its models identified in the time and scope available. It will miss things. An audit that raises no critical findings means only that none were found, never that none exist, and must not be relied upon as confirmation that a model is correct, complete, or fit for any purpose. Conversely, a reported finding is a suspicion to be checked by a competent human, not an established fact.
You remain responsible for your model. If you use a financial model to raise capital, set prices, make investment decisions, support a valuation, or inform any other consequential decision, that responsibility is yours and is not transferred, shared, or diminished by having run it through Finixr.
11. Service availability
We aim to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, infrastructure issues, or events beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.
12. Limitation of liability
To the maximum extent permitted by applicable law, Albusi GmbH and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or business — arising from your use of or inability to use the Service.
Our total aggregate liability to you for any claims arising under or related to these Terms shall not exceed the total fees paid by you to Albusi GmbH in the twelve (12) months immediately preceding the claim, or CHF 500, whichever is greater.
13. Indemnification
You agree to indemnify and hold harmless Albusi GmbH from any claims, damages, losses, or costs (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) your content submitted to the Service; or (c) your violation of any third-party rights.
14. Governing law and dispute resolution
These Terms are governed exclusively by the laws of Switzerland, without regard to conflict of law principles. Any dispute arising from or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Zurich, Switzerland. If you are a consumer in the EU, mandatory consumer protection laws of your country of residence may also apply.
15. Changes to these terms
We may update these Terms from time to time. We will notify users of material changes by email at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must cancel your subscription before the effective date.
